SEC structure remains approved

The SEC order dated September 21 permits ARK Venture Fund to offer a separate tokenized share class. The structure can record ownership with distributed-ledger technology and allows the shares to trade on alternative trading systems or move between approved wallets, subject to the order’s conditions.

The order covers both a national-exchange-listed class and a separate tokenized class. Any ATS involved must operate under Regulation ATS and be run by an SEC-registered broker-dealer that is a FINRA member.

No ATS or trading date identified

As of 08:18 UTC on September 26, the current Crypto Times report and the SEC order still provide no ATS launch date. The latest report states that trading of the tokenized shares had not begun.

The SEC order is a permissioning milestone, not an announcement of a live public market. No new venue or commencement date was identified in the refreshed source check.

The latest report says ARK Venture Fund and ARK Investment Management filed the application on May 20, 2026, with amendments in June and August. The SEC published notice in August, no hearing request was filed, and the exemptions became effective immediately.

Investor protections and limits

The fund must disclose its net asset value per share each business day and warn that transactions can occur above or below NAV. Tokenized shares will not be subject to early withdrawal charges under the approved structure, while rules for multiple share classes, fees and class-specific expenses still apply.

Wallets must pass know-your-customer, anti-money-laundering and sanctions checks. Only approved wallets may hold the tokenized class, keeping the blockchain-based transfer system inside a controlled compliance framework.
